These Terms of Use (including the Content Safety Policy below) govern your access to and use of the Service. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is intended for users aged 18+ (or the age of majority required by local law, whichever is higher). By using the Service, you represent that you meet this requirement.
No Random or Anonymous User-to-User Chat: VESPERLY is a curated character narrative experience and does not provide random matching or anonymous user-to-user chat features.
We use third-party analytics and advertising measurement tools (e.g., Google Firebase, Meta (Facebook) SDK, and Google AdMob) to operate, improve, and measure the performance of the Service.
“User Content” includes text you submit, including chat messages and character profiles/descriptions/prompts you create.
You represent that your User Content does not violate these Terms or the rights of others (including copyright, trademark, privacy, or publicity rights).
You grant AlphaFlow Limited a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content only as needed to operate, secure, moderate, and improve the Service.
No Image Uploads: The current version does not support uploading images.
We may store conversation history to provide continuity.
We maintain zero tolerance for objectionable content and abusive users.
Users who generate, request, or distribute content involving minors, non-consensual content, hate speech, or illegal content will have their access revoked immediately.
You may not use the Service to create, request, or share:
The App provides a functional, unified Reporting and Blocking feature to handle objectionable content.
Reporting: Users can report any character or content that violates these terms. Reports are reviewed within 24 hours.
Blocking: Users can immediately block any character or content to prevent further interaction.
Action: We will remove offending content and/or eject users who violate these terms.
We may remove User Content and suspend or terminate access if you violate these Terms or if we detect security risks. Severe violations may result in immediate termination without notice.
If you believe an enforcement action was in error, you may appeal via the in-app feature or by emailing [email protected] with the subject “Safety Appeal”.
Some features may require a subscription or the purchase of virtual currency (“Coins”). All payments are processed by Apple using your Apple ID. We do not collect or store your full payment details.
Payment: Payment will be charged to your iTunes Account at confirmation of purchase.
Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Account will be charged for renewal within 24 hours prior to the end of the current period.
Management: You can manage or cancel subscriptions in your App Store Account Settings after purchase.
Restoration: Active subscriptions can be restored via the “Restore Purchase” button in the app.
Purchases and subscriptions are subject to Apple’s refund policies. We cannot issue refunds directly. Refund requests must be submitted to Apple.
The Service is provided “as is.” We do not guarantee error-free operation or that AI outputs will be accurate.
To the maximum extent permitted by law, AlphaFlow Limited is not liable for indirect or incidental damages arising from your use of the Service.
We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
